Terms and Conditions for Tutoring Services by Rising Future LLC and CODEie LLC

These terms and conditions (“Agreement”) are entered into by and between [Rising Future Learning Center and CODEie], hereinafter referred to as the “Learning Centers,” and the undersigned student and/or their parent/guardian, collectively referred to as the “Client.”

1. Services Provided: The Learning Centers agrees to provide tutoring services to the Client in accordance with the selected program and subjects. Tutoring sessions will be conducted by qualied instructors.
2. Enrollment and Payments:
    a. The Client agrees to pay the agreed-upon fees for the selected tutoring program.
    b. Payment is due in advance of each session or as specied in the payment schedule.
    c. Missed sessions may not be credited or refunded, except under exceptional circumstances agreed upon by both parties.
    d. If both parties agree on a refund for the group class, it will be charged at $40/hour for the completed hours.
3. Scheduling and Rescheduling:
    a. Tutoring sessions will be scheduled based on mutual availability between the Learning Centers and the Client.
    b. Rescheduling requests must be made with at least 24 hours’ notice, otherwise, the session may be considered missed.
4. Cancellations and Refunds:
    a. Cancellation of the group class program may be subject to a refund. If both parties agree on a refund for the group class, the used hours will be charged at $40/hour.
    b. No Refunds in any circumstance, if ‘No Refund” is written on the invoice.
5. Conduct and Behavior:
    a. The Client agrees to behave respectfully and professionally during tutoring sessions.
    b. Any inappropriate behavior, including but not limited to, harassment or disrespect towards tutors, staff, or fellow students, may result in termination of services.
6. Liability and Disclaimers:
    a. The Learning Centers shall not be held liable for any academic results or performance improvements resulting from the tutoring services.
    b. The Learning Centers is not responsible for any damage to personal property brought to tutoring sessions.
7. Condentiality: Both parties agree to maintain the condentiality of all proprietary or condential information obtained during tutoring sessions.
8. Media Release: The Client acknowledges that photographs, videos, or audio recordings of the student may be used for promotional materials unless expressly denied in writing.
9. Entire Agreement: This Agreement constitutes the entire understanding between the Learning Centers and the Client and supersedes all prior discussions, negotiations, or agreements, whether written or oral.

Release of Liability
I hereby preemptively waive, release, discharge, and exempt the provider (Rising Future Learning Center LLC) from any and all potential actions, claims, damages, costs, loss of services, and expenses arising from any known or unknown personal injuries or property damage resulting from my child’s program attendance.
I grant permission for myself/my child to partake in this activity, assuming its associated risks, and I pledge to hold Rising Future LLC and its staff entirely harmless and indemnied from liability for any injuries I/my child may incur due to this participation.
Furthermore, I acknowledge that photographs, videotapes, and audio recordings of the participants may be captured during their involvement in the learning centers classes. I hereby authorize the use of these materials depicting myself/my son/daughter, whether as an individual or as part of a group, with or without accompanying text, for the Learning Center’s Activities.
